1. Acceptance of Terms
Welcome to Viralance. By accessing or using our AI-powered video generation platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
2. Service Description
Viralance is an AI-powered video generation platform that enables users to:
- Generate videos using advanced AI models (VEO 3 and SORA 2)
- Create videos ranging from 4 to 12 seconds in duration
- Enhance prompts using AI-powered prompt enhancement
- Generate captions automatically for videos
- Post videos directly to TikTok (subject to TikTok's terms)
- Manage video content through a dashboard
- Schedule videos for future posting (coming soon)
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.
3. Account Registration
To use certain features of the Service, you must register for an account using Google authentication. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
4. Credits and Payment
4.1 Credit System
Viralance operates on a credit-based system. Credits are required to generate videos using our AI models:
- VEO 3 Model: 20 credits per video
- SORA 2 Model: 50 credits per video
4.2 Credit Packages
We offer the following credit packages:
- Starter: 100 credits for $29
- Pro: 250 credits for $59
- Business: 500 credits for $99
- Enterprise: 1500 credits for $299
4.3 Payment Processing
Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. All prices are in USD and are subject to change with notice.
4.4 Refund Policy
If you're not satisfied with the Service or experience unexpected credit usage, you may contact our support team at info@alimertgulec.com. We will review your case on an individual basis and process a refund if we determine it is applicable. Refund decisions are made at our sole discretion.
4.5 Credit Expiration
Credits do not expire and remain available in your account until used. However, we reserve the right to deactivate accounts that have been inactive for more than 24 months.
5. Acceptable Use Policy
You agree not to use the Service to create, upload, post, or share content that:
- Violates any applicable laws or regulations
- Infringes on intellectual property rights of others
- Contains malware, viruses, or other harmful code
- Is defamatory, obscene, pornographic, or sexually explicit
- Promotes violence, discrimination, or hatred
- Contains misleading or deceptive information (deepfakes of real people without consent)
- Harasses, threatens, or bullies others
- Violates the privacy rights of others
- Impersonates any person or entity
- Attempts to manipulate or deceive others for malicious purposes
You also agree not to:
- Attempt to reverse engineer or hack the Service
- Use automated systems to access the Service (bots, scrapers)
- Resell or redistribute credits or access to the Service
- Use the Service to compete with us or create similar services
- Overload or interfere with the operation of the Service
Violation of this policy may result in immediate termination of your account without refund.
6. User Content and Intellectual Property
6.1 Ownership of Generated Content
You retain all ownership rights to the videos you generate using the Service. Viralance does not claim ownership of your generated content.
6.2 License to Viralance
By using the Service, you grant Viralance a limited, non-exclusive, worldwide license to:
- Store and process your prompts and generated videos
- Display your content in your account dashboard
- Use anonymized, aggregated data for service improvement
- Display examples of generated content for marketing purposes (with your explicit consent only)
6.3 AI Model Providers
Video generation is powered by third-party AI models (FAL.AI's VEO 3 and SORA 2). By using these models, you agree to their respective terms of service. Generated content may be subject to those providers' policies.
6.4 Responsibility for Content
You are solely responsible for the content you generate and share. You represent and warrant that you have all necessary rights to use the prompts you submit and that your use complies with all applicable laws.
7. TikTok Integration
7.1 TikTok Connection
Viralance allows you to connect your TikTok account to automatically post generated videos. By connecting your TikTok account, you:
- Authorize Viralance to access your TikTok account using OAuth 2.0
- Grant permission to post videos on your behalf
- Acknowledge that posted videos are subject to TikTok's Terms of Service and Community Guidelines
- Accept that TikTok may remove or restrict videos that violate their policies
7.2 Token Storage and Refresh
We securely store your TikTok access tokens and refresh them automatically. You can disconnect your TikTok account at any time through your Settings page.
7.3 TikTok Rate Limits
TikTok's API has rate limits (6 requests per minute per user). We automatically manage these limits, but posting may be delayed during high usage periods.
7.4 Development Mode Limitation
During TikTok's development/testing phase, all videos are posted as PRIVATE. After TikTok approves our production application, videos will be posted with your selected privacy setting (Public, Friends, or Private).
8. Third-Party Services
Our Service integrates with the following third-party providers:
- Firebase (Google): Authentication, database, and hosting. Subject to Google's Terms of Service.
- FAL.AI: AI video generation models (VEO 3, SORA 2). Subject to FAL.AI's Terms of Service.
- TikTok: OAuth authentication and video posting. Subject to TikTok's Terms of Service and Privacy Policy.
- Stripe: Payment processing. Subject to Stripe's Terms of Service and Privacy Policy.
We are not responsible for the actions, content, or policies of these third-party services. Your use of these services is subject to their respective terms and privacy policies.
9. Termination
9.1 Termination by You
You may terminate your account at any time by contacting info@alimertgulec.com. Upon termination, you will lose access to all unused credits (no refunds will be issued).
9.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms of Service
- You violate our Acceptable Use Policy
- You engage in fraudulent or illegal activity
- You abuse or manipulate the Service
- We are required to do so by law
9.3 Effect of Termination
Upon termination:
- Your right to use the Service immediately ceases
- All unused credits are forfeited without refund
- Your account data may be deleted after 30 days
- Generated videos in your account will no longer be accessible
- TikTok connections will be automatically disconnected
10. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Uninterrupted, secure, or error-free operation
- Accuracy, reliability, or quality of generated content
- Compatibility with your devices or software
We do not guarantee that:
- The Service will meet your specific requirements
- Generated videos will be of satisfactory quality
- Videos posted to TikTok will comply with their policies
- Third-party AI models will always be available
- Your account data will never be lost or corrupted
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
This limitation applies to:
- Service interruptions or unavailability
- Data loss or corruption
- Generated content quality or usability
- TikTok account suspension or content removal
- Third-party service failures (FAL.AI, Firebase, Stripe, TikTok)
- Unauthorized access to your account
- Errors, bugs, or security vulnerabilities
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO VIRALIFY IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such cases, our liability will be limited to the maximum extent permitted by law.
12. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:
- Posting the updated Terms on this page
- Updating the "Last updated" date at the top
- Sending an email notification (for significant changes)
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you disagree with the changes, you must stop using the Service and may request account deletion.
